General Terms and Conditions

1. Scope
1.1 We carry out deliveries in accordance with the following General Terms and Conditions. All contracts concluded on the basis of our online shop offerings are based on these terms and conditions.

1.2 "Consumers" in the sense of these General Terms and Conditions are natural persons, for whom the purpose of their online order cannot be ascribed to a commercial, entrepreneurial or freelance activity. "Merchants" are natural or legal persons or legally constituted private limited companies, for whom the purpose of the online order can be ascribed to a commercial, entrepreneurial or freelance activity. "Customers" in the sense of these General Terms and Conditions are consumers as well as merchants.

2. Contractual partners, language and contract conclusion
2.1 Your contractual partner is Rebecca Trade GbR, represented by Dirk Bartos, Andreas Kersten and Sören Müller. At the moment, online shop contracts can only be concluded in German and English. Our offers are non-binding unless they become the object of a contractual agreement.

2.2 It is possible for you to correct the information you have entered before placing your order. By placing your order, you enter into a legally binding contract. A receipt confirmation is issued immediately upon the technically correct receipt of your order. The receipt confirmation does not constitute an order confirmation; it simply serves as a confirmation of your order having been correctly received by us.
A binding contract comes into force once we accept your order. We may accept your order as follows:
• we issue a separate order acceptance notification or
• we ask you for your payment if you have chosen the prepayment option or
• your receive your ordered goods.
Please note that if you have chosen the prepayment option, the order will only be delivered after the total amount has been credited to our account.

3. Prices, shipping costs
3.1 The prices indicated in our online shop at the time of order apply for orders. The indicated prices are final prices, i.e. they include the statutory German VAT rate as well as other pricing components.
Details regarding any additional shipping costs can be found in the information provided in the online shop under "Delivery and shipping costs".

3.2 Additional charges may arise in case of deliveries outside Germany at the time of import into a third country (customs, duties and import tax). These additional costs are the responsibility of the customer.

4. Payment, delivery
4.1 We offer the following payment options:
• Prepayment via bank transfer
You will receive the details for your transfer after you have placed your order.
• CoD (Cash on Delivery) (only available within Germany)
An additional collection fee will apply.
• PayPal

4.2 We deliver via DPD or DHL. You will receive a notification from us when your goods leave our premises.

4.3 Our obligation to deliver shall not apply in cases where we have not been supplied with the goods correctly and in good time and the non-availability of the goods is therefore not caused by us. You will be notified immediately if your ordered goods are not available. Any prepayment received from you via credit card or bank transfer will be credited without delay.

4.4 Where the customer is a consumer, the risk of accidental loss and/or deterioration for mail order purchase goods is transferred from the carrier to the consumer at the time of handover to the consumer or to a third party recipient designated by the consumer. In all other cases, the risk of accidental loss and/or deterioration for mail order purchase goods is transferred to the carrier or another person or entity designated to carry out the delivery to the Customer at the time of handover.

5. Retention of title
The goods shall remain our property until payment is received in full.

6. Privacy notice
Our privacy policy is subject to the legal regulations.

7. Contract text storage
We store the text of the contract and will send you your order information and T&C via email. You can review and download our T&C from this website at any time. A record of your order history is maintained in our customer login section.

8. Applicable law, place of jurisdiction
8.1 The laws of the Federal Republic of Germany shall apply for all legal transactions or other legal relationships with us.

8.2 Our registered offices shall be agreed as place of jurisdiction for all business transactions with merchants and with legal entities under public law. We are therefore optionally entitled to issue legal claims at the location of the customer’s registered offices.

9. Severability clause
Where any individual stipulations of these General Terms and Conditions are completely or partially invalid or lose their validity at a later time, the remainder of the General Terms and Conditions shall retain its validity and remain unaffected. Legally valid stipulations shall take the place of invalid stipulations. The same shall apply where the General Terms and Conditions include an unforeseeable loophole.
